Retention
Personal data will not be retained for longer than necessary to fulfil the purpose for which it was obtained, and in accordance with our data retention schedule.
Back office computer system and paper records will be kept up to a maximum of 6 years and 1 month.
Body worn video camera footage of encounters will be retained for as long as the necessary. If the matter is subject to legal proceedings the footage may be kept for up to 6 years (the expiry of the statutory time for any and all appeals). All other footage will be kept for a period of 18 months as the footage forms part of the evidence of an offence. The retention of evidence is to:
- cover any applications to set aside prosecution
- provide evidence if false identities are used
- protect the subject and the officer from any civil claims
- to ensure fair enforcement, especially where a person may commit multiple offences.
