Information about the older-type Part VII Highways Act pavement café licence
Following a change in the law on 31 March 2024, it is no longer possible for food and drink businesses to apply for this older type of licence for the purposes of placing removable furniture on the highway.
If you have a current Part VII Highways Act licence, you may continue to use your licence as per its terms and conditions until its expiry date. You will not be able to renew this older type of licence.
To continue to use removable furniture on the Highway after your Part VII Highways Act licence expires, you will need to make an application for the new type of Pavement Licence at least 28 days before the expiry date of your current licence. In this circumstance, you should choose "renewal" at the appropriate stage of the application form.
If you have any questions about either type of Pavement Licence, email citycentre@birmingham.gov.uk
